BaleBet Terms of Service

1. Acceptance of Terms
Welcome to BaleBet! These Terms of Service ("Terms," "ToS," or "Agreement") constitute a legally binding agreement between you ("you," "your," or "User") and BaleBet ("we," "us," or "our") governing your access to and use of the BaleBet mobile application (the "App") and any related services.
By creating an account, downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
2. Description of Service
BaleBet is a property management application designed for property owners, managers, and real estate professionals. The App provides tools to:
- Track and manage properties, including floors and rooms
- Maintain tenant records and contact information
- Manage leases and rental agreements
- Record and monitor payment information
- Store property-related documents and media
- Generate reports and export data
- Collaborate with team members (in applicable membership tiers)
- Sync data across devices (in applicable membership tiers)
The specific features available to you depend on your membership tier.
3. Eligibility & Account Requirements
3.1 Age Requirement
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.
3.2 Account Creation
To access certain features of the App, you must create an account by providing:
- A valid email address or phone number
- A username
- A secure password
- Any other information required during the registration process
3.3 Account Accuracy
You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and current
- Notify us immediately of any unauthorized access to or use of your account
3.4 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Any actions taken using your account, whether or not authorized by you
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.
4. Membership Tiers & Features
4.1 Available Tiers
BaleBet offers multiple membership tiers, which may include but are not limited to:
- Free tier
- Trial tier
- Standard tier
- Premium tier
- Enterprise tier
Each tier provides different features, storage options, and limitations. Full details of each tier's features are available within the App.
4.2 Local vs. Cloud Storage
Local-Only Tiers: Data you create is stored exclusively on your device and is not automatically uploaded to our servers. You are solely responsible for backing up this data.
Cloud-Enabled Tiers: You have the option to sync your data to our cloud servers. Syncing is a manual, user-initiated action. We do not automatically sync or back up your data without your explicit action.
4.3 Changes to Tiers
We reserve the right to:
- Modify features, pricing, or availability of any membership tier
- Add or remove membership tiers
- Change tier limitations or capabilities
We will provide reasonable notice of material changes that negatively affect your access to features you have paid for.
5. License Grant & Restrictions
5.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download, install, and use the App on devices you own or control
- Access and use the App's features in accordance with these Terms and the features available in your membership tier
5.2 License Restrictions
You agree NOT to:
Reverse Engineering & Modification
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App
Unauthorized Access & Use
- Use the App for any purpose other than its intended property management functionality
- Access or attempt to access any part of the App or our systems through any automated means (bots, scrapers, etc.)
- Bypass any security measures or access controls
- Access another user's account without authorization
- Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
Commercial Misuse
- Sell, rent, lease, sublicense, or otherwise commercialize access to the App without our express written permission
- Use the App to provide services to third parties without authorization
- Use the App in any way that competes with BaleBet's business
Prohibited Content & Activities
- Upload, store, or transmit any illegal, fraudulent, or harmful content
- Use the App to harass, abuse, threaten, or intimidate others
- Violate any applicable laws or regulations in connection with your use of the App
- Use the App to infringe upon intellectual property rights of others
6. User Content & Data
6.1 Your Content
You retain all ownership rights to the data, information, documents, photos, and other content you create, upload, or store in the App ("User Content"). This includes property records, tenant information, leases, payment records, and documents.
6.2 License to Us
By using the App, you grant us a limited, non-exclusive, royalty-free license to:
- Store, process, and transmit your User Content as necessary to provide the App's services
- Create backups of User Content stored on our cloud servers
- Display User Content to you and team members you explicitly authorize
This license exists solely to enable us to operate the App and provide services to you. We will not use your User Content for any other purpose without your explicit consent.
6.3 Your Responsibilities
You are solely responsible for:
- The accuracy, legality, and appropriateness of all User Content
- Obtaining any necessary rights, consents, or permissions to store and process User Content (including tenant personal information)
- Complying with all applicable data protection and privacy laws regarding tenant and property data
- Backing up your User Content
6.4 Prohibited Content
You agree not to upload, store, or transmit User Content that:
- Is illegal, fraudulent, defamatory, or violates any third-party rights
- Contains viruses, malware, or other harmful code
- Violates any applicable laws or regulations
- Infringes upon intellectual property rights
6.5 Content Removal
We reserve the right to remove or refuse to store any User Content that violates these Terms, violates applicable laws, poses a security risk, or is reported by other users as inappropriate.
We are not obligated to monitor User Content but may do so to ensure compliance with these Terms.
7. Data Privacy & Protection
Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You acknowledge that:
- You have read and understood our Privacy Policy
- You consent to the data practices described in the Privacy Policy
- You are responsible for complying with applicable data protection laws when storing tenant and property information

8. Team Collaboration Features
8.1 Team Access
Certain membership tiers allow you to invite team members to access and collaborate on property data.
As the account owner, you are responsible for:
- Managing which team members have access to your data
- Ensuring team members comply with these Terms
- Revoking access when appropriate
- All actions taken by team members you authorize
8.2 Team Member Obligations
Team members who access your data must:
- Use the data only for authorized property management purposes
- Maintain confidentiality of sensitive information
- Comply with these Terms and applicable laws
- Not share access credentials with others
9. Payment Terms
9.1 Current Payment Model
The App currently tracks payment information for record-keeping purposes only. The App does not process actual payments or collect payment card information.
9.2 Subscription Fees (If Applicable)
If you subscribe to a paid membership tier:
- Fees are charged according to the pricing displayed at the time of subscription
- Subscription fees are typically charged on a recurring basis (monthly or annually)
- You authorize us to charge your payment method for applicable fees
- All fees are non-refundable except as required by law or expressly stated in our refund policy
9.3 Price Changes
We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of price increases for existing subscriptions. Continued use of the App after the price change takes effect constitutes acceptance of the new pricing.
9.4 Taxes
You are responsible for all applicable taxes associated with your use of paid features, except for taxes based on our net income.
10. Data Backup & Loss
10.1 Your Backup Responsibility
YOU ARE SOLELY RESPONSIBLE FOR BACKING UP YOUR DATA.
The App provides backup and sync tools, but you must manually initiate backups and syncs, verify successful completion, and maintain your own independent backups of critical data.
10.2 Our Assistance
If you experience data loss, we will make reasonable efforts to assist in recovery, but we cannot guarantee successful data recovery.
10.3 No Automatic Backups
The App does not automatically back up or sync your data in the background. All backup and sync operations must be explicitly initiated by you.
11. Intellectual Property Rights
11.1 Our Property
The App and all associated intellectual property rights (including software code, UI designs, logos, trademarks, documentation, and materials we create) are and remain the exclusive property of BaleBet and our licensors. These Terms do not grant you any ownership rights to the App or our intellectual property.
11.2 Trademarks
BaleBet and all related logos, product names, and service names are trademarks or registered trademarks of BaleBet. You may not use these trademarks without our prior written permission.
11.3 Feedback
If you provide us with feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.
12. Third-Party Services & Links
12.1 Third-Party Services
The App may integrate with or rely on third-party services (such as cloud storage providers). Your use of such services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or performance of third-party services.
12.2 Third-Party Links
The App may contain links to third-party websites or resources. These links are provided for convenience only. We do not endorse and are not responsible for the content, products, or practices of third-party sites.
13. Disclaimers & Warranties
13.1 "AS IS" Basis
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, uninterrupted service, security, and error-free operation.
13.2 No Professional Advice
The App is a tool for organizing and tracking property management information. It does not provide legal, financial, tax, or professional advice. You should consult with qualified professionals for such advice.
13.3 Data Accuracy
We do not guarantee the accuracy, completeness, or reliability of any data or information provided through the App. You are responsible for verifying all information and data.
14. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, business opportunities, or goodwill, and damages arising from your use or inability to use the App, data loss/corruption, unauthorized access, errors/bugs/defects, third-party actions, or force majeure events.
14.2 Liability Cap
Our total aggregate liability for all claims arising from or related to these Terms or your use of the App shall not exceed:
- For paid subscriptions: the amount you paid us in the 12 months preceding the claim
- For free accounts: USD $100 (or equivalent in your local currency)
14.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless BaleBet, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to your use or misuse of the App, your violation of these Terms, your violation of laws, your User Content, your violation of third-party rights, or actions taken by team members you authorize.
16. Termination
16.1 Termination by You
You may terminate your account at any time by using the account deletion feature in the App (if available) or contacting us to request account deletion. Upon termination, you will lose access to cloud-stored data. Make sure to export any data you wish to retain before deleting your account.
16.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason including violation of these Terms, fraudulent/abusive/illegal activity, non-payment (for paid subscriptions), extended inactivity, security risks, or legal/regulatory requirements.
16.3 Effect of Termination
Upon termination:
- Your license to use the App immediately ceases
- Your access to cloud-stored data will be revoked
- We may delete your account and server-stored data in accordance with our data retention policies
- Provisions that by their nature should survive termination shall continue in effect
17. Modifications to the App & Terms
17.1 Changes to the App
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time; add or remove features; change how features operate; and impose limits or restrict access. We will provide reasonable notice of material changes that significantly affect your use of the App.
17.2 Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email, update the "Last Updated" date, and may require review/acceptance. Continued use after notice constitutes acceptance. If you do not agree, you must stop using the App and may delete your account.
18. Dispute Resolution
18.1 Informal Resolution
If you have a dispute with us, please contact us first to attempt to resolve the issue informally. Most disputes can be resolved through good-faith communication.
18.2 Binding Arbitration (Where Applicable)
If we cannot resolve a dispute informally, you and BaleBet agree that disputes may be resolved through binding arbitration rather than in court, except where arbitration is not permitted by applicable law.
18.3 Class Action Waiver
To the fullest extent permitted by law, disputes must be brought on an individual basis only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
18.4 Exceptions
The following disputes are not subject to arbitration: disputes relating to intellectual property rights, claims for injunctive relief, and small claims court actions (where applicable).
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BaleBet regarding your use of the App and supersede all prior agreements and understandings.
19.2 Severability
If any provision is found invalid/illegal/unenforceable, remaining provisions remain in effect, and the invalid provision shall be modified to the minimum extent necessary to be valid and enforceable.
19.3 Waiver
Our failure to enforce any provision shall not constitute a waiver. No waiver is effective unless made in writing and signed by an authorized representative.
19.4 Assignment
You may not assign your rights/obligations without prior written consent. We may assign these Terms without restriction.
19.5 No Agency
Nothing creates any agency, partnership, joint venture, or employment relationship. You have no authority to bind BaleBet.
19.6 Force Majeure
We are not liable for failure/delay due to circumstances beyond reasonable control including natural disasters, war, terrorism, labor disputes, government actions, internet disruptions, or third-party failures.
19.7 Export Compliance
You agree to comply with applicable export/import control laws. You represent that you are not in a comprehensively sanctioned country and are not on restricted party lists.
19.8 Language
These Terms are written in English. Any translations are for convenience only. In the event of conflict, the English version prevails.

20. Governing Law
These Terms shall be governed by and construed in accordance with international commercial law principles and general contract law principles recognized across multiple jurisdictions, without regard to conflict of law provisions.
For users in jurisdictions that require a specific governing law or venue, the laws of the jurisdiction where the dispute arises or where you reside may apply to the extent required by mandatory local law.
21. User Conduct & Acceptable Use
21.1 Professional Use
The App is intended for legitimate property management purposes. You agree to use the App professionally and ethically.
21.2 Prohibited Activities
You agree NOT to:
Illegal Activities
- Use the App for any unlawful purpose
- Store or transmit content that violates any law or regulation
- Use the App to facilitate fraud, money laundering, or other criminal activity
- Violate any data protection, privacy, or consumer protection laws
Harmful Behavior
- Harass, threaten, or intimidate other users or team members
- Upload viruses, malware, or other malicious code
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the App's functionality or infrastructure
System Abuse
- Attempt to overwhelm our servers with excessive requests
- Use automated systems (bots, scrapers) to access the App
- Probe, scan, or test vulnerabilities in our systems
- Circumvent any security or authentication measures
Content Violations
- Upload false, misleading, or fraudulent information
- Impersonate others or misrepresent your identity or affiliation
- Infringe upon intellectual property rights of others
- Store or transmit obscene, defamatory, or harmful content
21.3 Consequences of Violations
Violation of these conduct rules may result in immediate suspension or termination, removal of violating content, legal action, and reporting to authorities where appropriate.
22. Compliance with Laws
22.1 Your Legal Obligations
You are responsible for complying with all applicable laws and regulations in connection with your use of the App, including laws governing tenant data and privacy, landlord-tenant laws, licensing requirements (if applicable), contract/lease laws, and business record keeping obligations.
22.2 Tenant Data Responsibility
When storing tenant information in the App, you represent and warrant that you have the legal right and necessary consents to collect/store such information and will use it only for legitimate property management purposes.
22.3 Disclaimer
BaleBet does not provide legal advice. The App is a tool for organizing information, not a substitute for legal counsel. You should consult qualified legal professionals regarding your obligations.
23. Support & Maintenance
We provide customer support through channels specified in the App. We may perform scheduled or emergency maintenance, and the App may be unavailable during those periods. We may release updates; some updates may be required to continue using the App.
24. Accessibility
We strive to make the App accessible. If you encounter accessibility barriers, please contact us and we will work to address them where feasible.
25. Feedback & Reviews
We welcome feedback. If you provide feedback, you grant us the right to use it without restriction or compensation. Reviews/ratings on third-party platforms should be honest and based on genuine experience.

27. Acknowledgment

- You understand the limitations on our liability and your responsibilities for backing up data
- You understand which features are available in your membership tier
- You are of legal age and have the legal capacity to enter into this agreement
- If using the App on behalf of a business/organization, you have authority to bind that entity
28. Survival
The following provisions survive termination: Sections 6, 11, 13, 14, 15, 18, 19 and any other provisions that by their nature should survive.

30. Final Notes
Effective Date: These Terms become effective on the date indicated at the top of this document or when you first use the App, whichever is later.
